1. Acceptance of Terms

Welcome to Agent Hita. These Terms and Conditions ("Terms") govern your access to and use of the Agent Hita website, applications, software, services, and related features (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, do not access or use the Service.

2. Description of Service

Agent Hita is a privacy-focused digital safety platform designed to assist users in identifying potential harmful digital influence, manipulation, coercion, grooming, financial scams, romance scams, social engineering, and other concerning behavioral patterns in digital communications.

The Service provides informational insights, alerts, and risk indicators only.

Agent Hita does not provide legal advice, medical advice, psychological counseling, financial advice, law enforcement services, or emergency services.

3. Eligibility

  • You must be at least eighteen (18) years old to create an account or administer the Service.
  • Parents, legal guardians, and authorized caregivers may use the Service where permitted by applicable law.
  • You are responsible for ensuring your use complies with all applicable laws and regulations.

4. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes.
  • Use the Service only on devices, accounts, or communications you are authorized to access.
  • Obtain any required permissions or consent before monitoring communications.
  • Maintain the confidentiality of your credentials.

  • Generate false negatives.
  • Misinterpret context.
  • Fail to identify harmful activity.
  • Incorrectly classify benign activity as risky.

No automated safety system can guarantee accurate detection of harmful behavior.

6. Not Emergency Services

Agent Hita is not an emergency response service. Do not rely on the Service for medical emergencies, mental health crises, threats of violence, self-harm situations, child endangerment emergencies, or criminal activity requiring immediate intervention. If there is an immediate risk to safety, contact emergency services or appropriate authorities.

7. Artificial Intelligence Features

  • AI-generated outputs are informational only.
  • Users remain solely responsible for all decisions made based on Service outputs.
  • AI-generated alerts should not be treated as factual determinations or evidence of wrongdoing.

8. Intellectual Property

All software, technology, trademarks, logos, branding, content, documentation, models, and related materials are owned by Agent Hita LLC or its licensors and are protected by intellectual property laws. No rights are granted except those expressly stated herein.

9. Open Source Components

Certain portions of the Service may incorporate open-source software. Such components remain governed by their respective licenses.

10. Feedback

Any feedback, suggestions, ideas, or recommendations submitted to Agent Hita may be used without restriction or compensation.

11. Third-Party Services

The Service may interact with third-party platforms, operating systems, cloud providers, messaging applications, or device manufacturers. Agent Hita is not responsible for third-party services or their practices.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENT HITA DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENT HITA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

THE TOTAL LIABILITY OF AGENT HITA SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED U.S. DOLLARS (USD $100), OR (B) THE AMOUNT PAID BY YOU TO AGENT HITA DURING THE PRECEDING TWELVE MONTHS.

14. Indemnification

You agree to defend, indemnify, and hold harmless Agent Hita LLC from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

15. Termination

Agent Hita may suspend or terminate access to the Service at any time for violations of these Terms or for security, legal, or operational reasons.

16. Governing Law

These Terms shall be governed by the laws of the State of Washington, United States.

17. Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration in Washington State, except where prohibited by law.


Child Safety and Guardian Use Policy

Agent Hita is intended to promote safety while respecting privacy.

Parents, guardians, and authorized caregivers remain responsible for all monitoring decisions.

Agent Hita is not a substitute for:

  • Parenting
  • Counseling
  • Education
  • Professional intervention
  • Law enforcement

The Service may provide age-appropriate safety controls, graduated disclosure mechanisms, and customizable risk thresholds where available.

Users are responsible for ensuring they have legal authority to monitor any individual.


Privacy Policy

Privacy First Philosophy

Agent Hita is built on the principle: "Safety should never come at the cost of privacy." Our goal is to maximize on-device processing and minimize data collection.

Information We Collect

We may collect:

  • Device Information — device model, operating system version, application version.

Agent Hita does not sell personal information. Information may be disclosed:

  • To enforce rights
  • To protect safety
  • During mergers, acquisitions, or asset transfers

Data Retention

Data is retained only as long as reasonably necessary for operational, legal, security, and compliance purposes. Users may request deletion of account-related information where applicable.

Security

We implement reasonable safeguards designed to protect information. No security system is guaranteed to be completely secure.


AI Transparency Policy

Agent Hita uses artificial intelligence, machine learning, and behavioral analysis systems to identify patterns that may indicate:

  • Financial manipulation
  • Romance scams
  • Grooming
  • Coercion
  • Social isolation tactics
  • High-pressure influence attempts
  • Emotional manipulation
  • Other potentially harmful behaviors

AI outputs are probabilistic and should not be considered factual conclusions.

Agent Hita cannot determine intent, predict future actions, diagnose conditions, or establish legal wrongdoing.

Users should independently evaluate all alerts and recommendations.


Acceptable Use Policy

You may not use Agent Hita to:

  • Stalk individuals
  • Harass individuals
  • Engage in unlawful surveillance
  • Facilitate abuse
  • Violate privacy laws
  • Collect data without authorization
  • Conduct unauthorized investigations
  • Interfere with Service operation

Violations may result in account suspension, termination, and reporting to appropriate authorities where required by law.


Cookie Policy

Agent Hita may use cookies and similar technologies to:

  • Maintain sessions
  • Improve functionality
  • Analyze performance
  • Measure reliability
  • Enhance user experience

Users may disable cookies through browser settings, though certain features may not function correctly. Where required by law, consent mechanisms will be provided.


DMCA and Copyright Policy

Agent Hita respects intellectual property rights. Copyright owners who believe content infringes their rights may submit a notice containing:

  • Identification of copyrighted work
  • Identification of allegedly infringing material
  • Contact information
  • Good faith statement
  • Statement under penalty of perjury

Agent Hita reserves the right to remove allegedly infringing content and terminate repeat infringers.


Law Enforcement Request Policy

Agent Hita believes privacy is a fundamental safety feature.

Where technically feasible, communications analyzed by Agent Hita remain on user devices and are not accessible to Agent Hita.

If Agent Hita receives legal requests for user information:

  • Requests will be evaluated for legal validity.
  • Information will only be disclosed when legally required.
  • We will seek to limit disclosures to the minimum legally required scope.
  • Where legally permitted, affected users may be notified.

If Agent Hita does not possess requested information, it cannot provide such information.


Responsible Disclosure and Security Policy

Agent Hita welcomes responsible reporting of security vulnerabilities. Researchers are encouraged to:

  • Avoid accessing user data.
  • Avoid disrupting services.
  • Provide sufficient detail for reproduction.
  • Allow reasonable time for remediation before public disclosure.

Data Processing Addendum (DPA) Summary

For enterprise, educational, nonprofit, and organizational customers:

  • Agent Hita acts as a service provider with respect to customer data.
  • Customers remain responsible for obtaining necessary permissions and consents.
  • Agent Hita processes data only as necessary to provide the Service.
  • Appropriate technical and organizational safeguards are maintained.
  • Data processing practices may be documented through separate enterprise agreements where required.
